TERMS & CONDITIONS

1. Arrival & Departure Times

Unless otherwise agreed by the Lessor, check in is at 2:00PM and check out is at 12:00PM. Early arrival is subject to availability and cannot be guaranteed. Guests can, however, reserve the villa ahead of time to ensure that the room is ready upon arrival. Check-in before 2:00PM costs $500 USD, and check-in before 8:00AM counts as a one-night stay. Late check-out is also subject to availability and is not guaranteed. Late check-out until 6:00 PM costs $500 USD, and check-out after that time is considered a one-night stay.

2. Registered Guests

Only the number of guests specified in the Booking Contract Invoice may stay at the property. The number of registered guests specified at the time of booking represents the maximum number of guests permitted. If the Lessor or the Lessor Representative discovers that the number of people staying at the property exceeds the number of registered guests, the Lessor or the Lessor Representative may, at his or her sole discretion, request that the extra person or persons pay the applicable additional charge at the published rate or vacate the property immediately. Unregistered guests are charged $150 USD per person per night.

3. Payment Terms

To confirm the reservation, a 50% deposit is required within three calendar days of booking. Payment in full is due 65 days prior to Lessee's arrival date.

4. Minimum Stay
Most of the year, a minimum two or three night stay is required. Kindly refer to the villa rates for all applicable seasonal minimum stay.

5. Security Deposit

A $1,000 USD security deposit is required upon arrival and must be paid in cash. Prior to check-out, it will be returned to the lessee.
If the villa sustains damage or breaks during the guests' stay, the costs will be deducted from the security deposit. Normal and acceptable wear and tear are not included. The condition of the property will be determined solely by the owner or the owner's representative. If the value of the damages or breakages exceeds the security deposit, the Lessee will be required to pay the difference to the Lessor as soon as possible.

 

6. Cancellation Policies
Notice of cancellation must be sent in writing via email to info@villasunyata.com and will follow the general cancellation fees below:
- Cancellation policy is applied according to property local time
- 20% of the total rental amount will be forfeited if the cancellation is made more than 65 days before the start of the rental period
- 50% of the total rental amount will be forfeited if the cancellation is made between 30 and 64 days before the start of the rental period
- 100% of the total rental amount will be forfeited if the cancellation is made between 1 and 29 days before the start of the rental period
- Any change of a confirmed booking is considered as a cancellation

- Christmas and New Year Period: All payments will be forfeited
- No show 100 % of total amount of reservation is due

 

7. Events & Weddings

If an event, wedding, or party is to be held on the property for a number of guests greater than the number of registered guests in the villa, a $1,500 USD Event Fee will apply, and the guest must notify the Lessor of the party. Furthermore, a $3,000 USD guarantee security deposit will be collected on site, from which a cleaning surcharge of up to $250 USD can be deducted before refunding to the Lessee if deemed necessary. Because the villa staff cannot assist with planning, all events and weddings must be organized by a professional planner. A wedding or event plan must be submitted to the Villa Manager for approval at least one month before the event date.

 

8. Lessee’s Insurance

Each guest must have comprehensive travel insurance that includes, but is not limited to, cancellation, flight delays, baggage loss and damage, and other property, as well as health insurance that includes, but is not limited to, evacuation and repatriation coverage. In addition, liability insurance is required.

 

9. Force Majeure
Lessor shall not be responsible for any delay, additional expense or inconvenience caused directly or indirectly by events outside of Lessor’s control such as civil disturbances, fires, floods, severe weather or Acts of God.

 

10. Complaints

The Lessor cannot be held liable for interruptions in the supply of water, electricity, internet connection or swimming pool filtration systems, though the Lessor will use reasonable efforts to resolve any such issues as soon as possible. If there are any problems that cannot be resolved by dealing directly with the local villa staff during the rental period, contact the Villa Manager immediately and they will rectify the situation to the best of their professional ability. It is understood that infrastructure, local standards, and conditions in remote resort locations are often less developed than in more urban environments. The Lessor or its representative will do everything reasonably possible to avoid and correct any problems. Any complaints should be submitted in writing to the Lessor within 24 hours of the occurrence.

 

11. Conduct & Behaviour

The Lessor is responsible for the correct and appropriate behavior of the villa's guests. If any member of the party behaves inappropriately, the Lessor or the Lessor's local representative may, at their sole discretion, ask the offending guest or guests to vacate the villa immediately, with no refund available from the Lessor. The owner or a representative of the owner has the right to enter the villa at any time.

 

12. Social Corporate Responsibility

It is illegal to act unlawfully in any way and to bring in, use, or consume any illegal substances. Any offenders will be reported to the police immediately. Furthermore, guests are not permitted to bring male or female outside guests back to the villa in accordance with its moral duty and respect for the local employees, as well as for the safety of our valued guests and the protection of the property.

 

13. Staff at the Villa

From 8 a.m. to 9 p.m., staff service is included in your villa stay. They are also available for late-night special events or early morning breakfast on occasion and with advance notice (extra hours can be charge at the discretion of the villa policy). A tip may be left at your discretion upon departure. Additional services, such as babysitting and driver services, can be pre-arranged and are subject to availability. It is not permitted to request that staff look after minor children. In order for staff such as pool maintenance workers and gardeners to complete their work, the Lessee must grant them access to the grounds.

14. Concierge Advise and Suppliers Recommendation

Villa Sunyata warrants to you that our team will use reasonable efforts to advise specific suppliers on The Lessee's request, including but not limited to Tour Operators/Boat Charter Companies (e.g., speedboat service, ferry service, boat/yacht charter service, massage service, ATV tours, Elephant Trekkings, and so on) in accordance with The Lessee's request and instructions from time to time. Villa Sunyata will select the supplier with reasonable care and ensure that the order is placed in accordance with The Lessee's wishes. Villa Sunyata does not and will not make any representations or recommendations about the information and suggestions contained in the suppliers' services. The Lessee is deemed to be responsible for, and shall use his own skill and judgment in determining the quality, value, and suitability of such information and suggestions in deciding whether to enter into any contract with any third party for the supply of services or the sale of goods.

The contract for the purchase of products or services by the Lessee is made solely with the relevant Supplier. Villa Sunyata acts as the Supplier's agent, and all of The Lessee's rights and remedies are against the Supplier, unless expressly stated otherwise. Villa Sunyata will not be liable for the Suppliers' products and services, or for any aspect of The Lessee's relationship with any particular Supplier. However, Villa Sunyata will do everything reasonably possible to assist The Lessee in any dealings The Lessee has with the Supplier. The Lessee agrees that any contract that The Lessee enters into with any of the Suppliers is an independent contract.

Villa Sunyata expressly disclaims any and all liability for any act or omission of any Supplier, as well as any loss incurred by The Lessee as a result of any act or omission of a Supplier, whether or not arranged through Villa Sunyata team advice. Villa Sunyata shall not be liable for any loss, cost, expense, or damage of any kind (whether direct or indirect) resulting from our team's advice or The Lessee's reliance on the information and suggestions provided by Villa Sunyata hereunder and the subsequent supply of goods and services to The Lessee by any third party.

 

15. Food and Beverage

All food and beverage purchases made on behalf of guests will be charged at cost plus 20%. The 20% surcharge covers cooking utilities, transportation, time spent shopping for groceries, and all other costs associated with cooking and kitchen-related expenses.

 

16. Linen & Towels

The Villa provides linen and towels. We have implemented a "Save the Planet" eco-policy, so linens are changed every three (3) days, or as needed. When towels are placed on the floor or in the towel basket, they will be replaced. If more frequent changes are required, additional fees may apply.

 

17. Furniture

Only exterior furnishings and designated outdoor furniture may be used outside the villa. All interior furnishings and furniture must remain inside the villa.

 

18. Transfers

All rates include one round-trip airport transfer. The Villa Manager can arrange for additional taxis and airport transfers.

 

19. Liability Waiver

The property is rugged, perched on a cliff, with steep stairs and drops, some uneven pathways, and flimsy tempered glass railings that can be dangerous when subjected to strong pressure. The pool, terrace, and outdoor and indoor areas are not supervised. The use of the pool and leisure equipment is entirely at the risk of the Lessee. The pool is not fenced, and its edges end in a steep cliff with a view of the ocean. Being near or in the ocean exposes you to a variety of risks and hazards, including strong currents, unexpected wave activity, floating debris, and other potential hazards. I accept all of the risks that come with being near or in the ocean, including the responsibility to warn all guests of such risks.

The Lessee accepts and acknowledges that he/she is responsible and liable for all guests and third parties staying at the Villa during the rental period. When staying at the villa, the Lessee and guests must exercise caution and keep an eye out for children playing on the terrace, by the rocks, near the entrance from the main road, or near or in the pool. When staying at the villa, children must be under the direct supervision of an adult at all times. Additionally, guests are not permitted to enter the villa if they are wet from swimming because the floors can be slippery. For the comfort and safety of all guests, guests must also refrain from jumping or diving into the pool. All guests (adults and children) are not permitted to sit, stand, or walk near the edges of the infinity pool, nor are they permitted to run around the pool area.

 

Overall, the property has the potential to cause serious bodily harm and/or death. Drowning, falling, sports injury, slips, trips, falls, cuts, adverse weather conditions, the acts or omissions of guests or visitors on the Property during my stay, and the condition of the Property are some of the risks. The Lessee should be aware that the risks described in this Liability Waiver are not exhaustive, and that other risks or events, known or unknown, anticipated or unexpected, may result in serious bodily injury and/or death.

Lessor shall not be liable for any damage or injury caused by the foregoing. Lessee accepts and acknowledges, and indemnifies and holds the Lessor harmless from and against, any liability resulting from any claims whatsoever resulting from accidents resulting in injury or death of any guests or visitors to the Villa during the rental period.

 

20. Smoking

The villa does not permit smoking indoor. Outside in the grounds, smoking is permitted, and the Villa Manager can provide an ash tray.

 

21. Pets
No pets are permitted in the villa or on the villa property.

 

22. Utilities

The rent includes all utilities bills. The windows must be closed when the air conditioner is on. An environmentally responsible policy is followed at Villa Sunyata. As a result, we ask that all air conditioning be turned off when you leave the villa or stay there for an extended amount of time; the Villa Staff may abide by this regulation.

 

23. Valuables

We always recommend using the villa's personal safety deposit boxes. It is strongly advised that valuable items such as passports, cash, traveler's checks, mobile phones, cameras, and so on be stored in it. The guests are solely responsible for any valuables left on the property, and neither the Lessor nor the staff can be held liable for any loss or damage to personal property.

24. Artwork & Entertainment Amenities

The villa contains a number of valuable contemporary and antique art pieces. This collection adds to the villa's uniqueness. Guests must be aware of the unique nature of these works of art and antiques and use extreme caution to avoid damage. Guests are also advised to exercise extreme caution when using the villa's entertainment amenities, such as the gym equipment, pool table, foosball table, or arcade game machine. Upon arrival, the Villa Manager or representatives will take an inventory of the entertainment items, including photographs to show the current state of the equipment. Any damage to entertainment equipment, artworks and antiques during the rental period is the responsibility of the Lessee, and any damages incurred by the Lessor will be offset against the aforementioned security deposit, and if these damages exceed the amount of the security deposit, the Lessee will be obligated to compensate the Lessor for the difference.
